Terms of Service

These Terms of Service (the "Terms") govern your use of the hosting services provided by QuantumVPS ("we", "us" or "the Service"). By creating an account or using the Service you accept these Terms in full.

1. Acceptance

By registering, ticking the "I agree to the Terms" checkbox or using any part of the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service description

QuantumVPS provides virtual private servers (VPS) and related hosting services on its own and third-party infrastructure. Specifications, capacity and pricing for each plan are published on our products page and may change with prior notice.

3. Your account

• You must be at least 18 years old or the legal age in your jurisdiction to subscribe.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• We strongly recommend enabling two-factor authentication (2FA) from your panel.
• Notify us immediately if you suspect unauthorized access to your account.

4. Payments and billing

• Services are billed recurrently (monthly or annually) according to the plan you subscribe to.
• Invoices are issued at the start of each period and are due within the timeframe stated on each document.
• If an invoice is not paid by its due date, the service may be suspended after a grace period (typically 7 days). If the debt persists, the service may be terminated with consequent data loss.
• Prices are quoted excluding taxes unless stated otherwise. Any applicable taxes are the customer's responsibility.

5. Refunds

Refund conditions are governed by our Refund Policy.

6. Acceptable use

Use of the Service is subject to our Acceptable Use Policy. Violations may result in immediate suspension without refund.

7. Customer data

The data you upload to your servers is yours. We do not access the contents of your virtual machines except as needed to operate the infrastructure, respond to a support request you submit, or comply with a binding legal obligation.

You are solely responsible for the content you host and for complying with applicable laws, including those relating to intellectual property and the personal data of your own end users.

8. Availability

We make reasonable efforts to maintain high availability, but we do not guarantee the Service will be uninterrupted, error-free, or always available. Scheduled maintenance windows are announced in advance whenever possible.

9. No warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all express or implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

In no event will QuantumVPS, its directors or employees be liable for indirect, incidental, special or consequential damages (including loss of data, profits or use) arising from the use of or inability to use the Service. Our total aggregate liability is limited to the amount paid by you in the 3 months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold us harmless from third-party claims arising out of your use of the Service in violation of these Terms or applicable law.

12. Changes

We may amend these Terms at any time. Material changes will be notified by email to the registered address and become effective 30 days later. Continued use after that date constitutes acceptance of the new Terms.

13. Termination

You may close your account at any time from the panel (after cancelling any active services). We may suspend or terminate your account immediately if you violate these Terms, the AUP, or if required by law.

14. Governing law

These Terms are governed by the laws of QuantumVPS's country of incorporation, without regard to its conflict-of-law rules. Any dispute will be submitted to the competent courts of that jurisdiction.
